Attorneys for former president Donald Trump will appeal Friday at a federal court of appeals, a $5 million verdict against E. Jean Carroll.
Trump is expected at the U.S. Circuit Court of Appeals hearing in New York City. Circuit Court of Appeals, New York City.
Carroll claimed that Trump raped Carroll at the Bergdorf Goodman department shop across from Trump Tower, Manhattan, sometime in 1996. Carroll was seeking $12 Million.
Last year, a federal jury in New York City ruled that Trump wasn’t liable for rape. However, he was found liable for sexual assault and defamation. In that trial, the former president was ordered by a federal jury to pay $5,000,000.
Carroll’s accusations have been vehemently rejected by Trump. He has said repeatedly that he doesn’t know her, and “absolutely has no idea who she is.”
Carroll sued Trump for defamation after he denied the allegations. She claimed that his response had damaged her reputation.
Trump and his legal team maintain that Carroll’s accusations are false. The former president’s first reaction included an accusation, that Carroll wanted to sell her book.
This year’s jury found that Carroll suffered injury as a consequence of Trump’s statements made at the White House in 2019.
The jury found that Trump’s comments were intended to harm Carroll, and she was awarded $65 million as punitive damages. The jury determined that Carroll should receive $83.3 million in total with the reputational restoration program.
Trump appealed the fine and asked for a new trial on the defamation case, but this request was denied by April.
On Friday, Trump’s attorneys are expected to argue the jury verdict should be overturned because evidence that should have been excluded was admitted at trial and other evidence that should have been allowed was not.
